The report notes Whitaker "knew he could not put Mr. Berman in charge" and Trump ultimately "soured" on him in the end.

Initially Cohen was going to testify before the committee on February 7, but it was postponed late last month over concerns about the threats against his family by President Donald Trump and Rudy Giuliani.

CNN previously reported that the Justice Department was investigating the leak previous year of the confidential reports related to Cohen's banking activity.

Daniels says she had an affair with Trump.

That transaction led to Cohen's pleading guilty to the charge of violating campaign finance law.

Fry is charged with leaking the confidential documents to Avenatti, who has chased Trump and Cohen over hush payments made to his client and porn star Stormy Daniels. Cohen is expected to be questioned by the oversight committee about payments before Election Day in 2016 to buy the silence of women who allege they had sexual relationships with Trump.

Four days after The Post's story was published in May, according to the criminal complaint, Fry allegedly placed a call to Ronan Farrow, a reporter for the New Yorker.

In fact, the SARs that were not available to Fry had been given "restricted access" in the system "because they were related to a sensitive open investigation".

Fry's case is the second in recent months in which a government employee has been charged with disclosing suspicious-activity reports related to persons of interest in special counsel Robert S. Mueller III's investigation.

The documents released by Avenatti also contained financial records of a different Michael Cohen.

Fry has declined to take a felony plea deal that would result in a sentence of probation, a source told CNN.

A message left on Thursday for an attorney for Fry, Gail Shifman, was not immediately returned. The scope of the Oversight Committee's open public hearing will not include questions relating to the Intelligence Committee's investigation of efforts by Russian Federation to influence the 2016 election and other matters.

Cohen will also provide closed testimony to the House Intel Committee.

He's been scheduled to testify before but ended up backing out of the plans, most notably because Trump sent a threatening tweet demanding investigations of Cohen's father-in-law.
